Controllers Panel Fees - VS05005

Plant Breeders` Rights (PBR) are a form of intellectual property protection available to breeders. A grant of PBR can be made in respect of any plant species. UK PBR is under the control of The Controller of Plant Variety Rights, who is also a senior Defra official.
In order to qualify for Plant Breeders` Rights a candidate must be shown to be distinct from any other varieties of the species in common knowledge, uniform and stable ie DUS.
Most DUS tests for UK PBR for ornamental species are conducted by NIAB in Cambridge (formerly the National Institute of Agricultural Botany).
Tests are conducted according to protocols agreed by the UK testing authorities. They are based on internationally agreed principles and methods. Tests are also conducted by them for foreign authorities, via Defra.
Decisions on ornamental varieties are taken by controllers panels. The members are experts on the species under consideration.
Meetings are held when required in order to make decisions on varieties under consideration.
The expenditure covered by this non R&D project relates to the travelling expenses necessarily incurred by the members of the panels in attending meetings.
